This Legal Notice shall apply regardless of any specific terms and conditions that TELEFÉRICO may establish to govern certain services and/or content—which, where applicable, must be accepted by the user before the corresponding service is provided—or the applicable General Terms and Conditions.

Only individuals 18 years of age or older may provide personal information through the forms and/or contact methods on the Platforms. Minors may participate in the booked activities, where applicable, under the responsibility and with the authorisation of their parents or legal guardians, and in accordance with the General Terms and Conditions of Purchase and the specific terms and conditions of each tour, activity, or experience.      

Access to and/or browsing of the Platform is free of charge.

If you are required to enter personal information in the forms available on the website, that information must be truthful, accurate, and up-to-date. TELEFÉRICO will process your data in accordance with the provisions of the Privacy Policy, which is the sole policy in effect on the Platforms and is available via the link. 

3. INTELLECTUAL AND INDUSTRIAL PROPERTY.

As a user, you agree to use the content and services made available on the Platform, which include, but are not limited to, text, graphics, images, icons, technology, software, links, and other digital, audiovisual, or audio content, as well as its graphic design and source code (hereinafter, the “content”), in accordance with the law, this Legal Notice, and the usage regulations and instructions provided to you. In particular, you agree to refrain from:

  • Reproducing, copying, distributing, making available, or otherwise publicly communicating, transforming, or modifying, in whole or in part, the services and content, unless authorised by the owner of the relevant rights or permitted by law.

All trademarks, names, distinctive signs, content architecture (design, navigation, organization, and taxonomy of the Platform and its content, etc.), and content or software of any kind incorporated into the Platform are the property of TELEFÉRICO or third parties, and at no time does your use of, or access to the Platform and/or its content or services grant you, as a user, any rights to the aforementioned trademarks, trade names, and/or distinctive signs, or to any other elements made available through the Platform.

Nothing in this Legal Notice shall be construed as granting or transferring to the user any rights in or to such intellectual or industrial property, except those strictly necessary for the proper use of or access to the Platforms and the services and content made available through them (namely, a personal, non-transferable, and non-sublicensable right of use, due to the nature of the service and the associated legal requirements).

  • Using bots, screen scraping, web scraping, or any other programming tool or means of any kind that allows for the extraction and, where applicable, reuse of information or data hosted, stored, or accessible on the Platforms without the express written authorization of TELEFÉRICO.

If you violate these prohibitions, and as soon as TELEFÉRICO becomes aware of such violations, we may notify you of the need to cease such activities, request their immediate removal or correction, or directly remove or block such content. We may also suspend, deactivate, or delete your user account, if you have one on any of the Platforms, without this giving rise to any rights or monetary compensation.

5. DISCLAIMER OF WARRANTIES AND LIABILITY.

  • TELEFÉRICO does not guarantee the availability or uninterrupted operation of the Platforms or the services provided through it, whether they are its own or those of third parties. Whenever reasonably possible, it will provide advance notice of any interruptions in the Platform's operation.
  • TELEFÉRICO does not guarantee that the content is free of viruses or other elements that could affect your system, although it will take the necessary measures to prevent and correct these problems.
  • TELEFÉRICO cannot fully guarantee the truthfulness, accuracy, completeness, timeliness, legality, reliability, and usefulness of the Platforms’ content and services, particularly those provided by third parties.
  • TELEFÉRICO may provide links, directories, and search tools (such as links, banners, and buttons) on the Platforms to make it easier for users to access websites managed by third parties. These links are provided solely to help users find information on the Internet.
  • TELEFÉRICO does not market or endorse the information, content, or services of the linked sites, nor does it monitor or control their content; users are solely responsible for browsing these sites.
  • TELEFÉRICO does not control or endorse the opinions, comments, or actions of users on the Platforms.
  • Platform users are, in general, solely responsible for the actions, reviews, content, and information they publish, transmit, communicate, or provide through the Platforms.

Despite the prohibitions and rules in place, TELEFÉRICO does not guarantee or assume responsibility for users' use of the Platform and its content. However, it may implement security systems and take corrective measures when it becomes aware of violations, ensuring the legitimacy of the services, content, and comments, without assuming any obligation to monitor them.

In all of the above cases, TELEFÉRICO disclaims any liability for damages that occur or may occur, to the fullest extent permitted by applicable law, whether to the user or to third parties.

6. LAW, APPLICABLE JURISDICTION.

This Legal Notice is governed in its entirety by Spanish law. Any dispute arising in connection with this Legal Notice shall be submitted to the courts of the city of Santa Cruz de Tenerife, unless applicable law designates other courts as having jurisdiction for such purposes. If, as a user, you are considered a consumer, the applicable jurisdiction will be that of your place of residence.

7. VALIDITY

If any provision of this Legal Notice is declared null and void or invalid, the remaining provisions shall remain valid and binding. Waiving compliance with a provision at a given time does not imply a waiver of the remaining provisions nor does it confer any additional rights.

8. AMENDMENT TO THE LEGAL NOTICE

TELEFÉRICO reserves the right to modify the layout and configuration of the Platforms, as well as this Legal Notice at any time. We recommend that you carefully read this Legal Notice each time you access the Platforms, as it may be subject to changes for legal, technical, or corporate reasons.
