These General Terms and Conditions of Purchase (hereinafter, “the Terms and Conditions” or “T&Cs”), together with the online purchase form and any Specific Terms and Conditions that may apply, constitute the contract between TELEFÉRICO DEL PICO DE TEIDE, S.A. (hereinafter, “TELEFÉRICO” or “we”) and any user interested in our Teide By Night tours, activities, or experiences (hereinafter, “the User” or “you”) made available through the Teide By Night purchasing platform, https://www.teidebynightbookings.com and www.teidebynight.com when said website links to the purchase process (hereinafter, the “Platform”). Please read these Terms and Conditions carefully, as they constitute a binding contract between the Parties.

When submitting the online purchase form, you must check the boxes labelled “I have read and accept the Terms and Conditions of Purchase” and “I have read and accept the Privacy Policy.” By checking the first box, you acknowledge that you have read these Terms and Conditions, declare that you accept them, and give your express consent to the entire contents of the contract as published at the time of acceptance, undertaking to comply with them without reservation. By checking the second box, you acknowledge that you have read and accepted the Privacy Policy, which is the only policy applicable to the processing of your personal data during the purchase process.

1. The Parties

These General Terms and Conditions are published in accordance with and in compliance with applicable law. In this regard, the Parties are as follows:

TELEFÉRICO DEL PICO DE TEIDE, S.A. (hereinafter “TELEFÉRICO”), a Spanish corporation with its registered office at Calle San Francisco, No. 5, 4th Floor, 38002, Santa Cruz de Tenerife, with Tax ID Number (CIF) A-38002549 and registered in the Santa Cruz de Tenerife Business Register on Page 15, Folio 174, Book 1 of Section 3.

And the User, who is identified through the information provided in the online purchase form, and is responsible for ensuring that such information is truthful, up-to-date, and accurate. In addition, the individual declares that they are at least eighteen (18) years old and have the legal capacity to enter into contracts. Parents and legal guardians are liable for any and all actions or damages caused by minors on the website.

2. Purpose

These Terms and Conditions govern the terms and conditions that apply to the User’s purchase of Teide By Night tours, activities, or experiences available through the Platform. 

The use of these online shopping services constitutes a contract between the parties, with the User’s full and unreserved acceptance of each and every provision of these T&Cs, without the need for or requirement by the parties to set them forth in writing.

3. Purchasing Process

Once the purchase has been made through the Platform, the User will receive an email confirming the purchase. Purchases on TELEFÉRICO will only be binding if they are confirmed by the User’s receipt of the aforementioned email and in accordance with the conditions set forth therein.

If the User detects any error in the information provided in the online purchase form, they must report it by email to info@teidebynight.com, by phone at +34 922 010 444, or through the contact methods provided on the Platform, within 24 hours of receiving the email. Otherwise, you will be deemed to have accepted the terms and conditions of the purchase set forth in these General Terms and Conditions.

Once the confirmation email has been received and the User has not raised any objections within the specified time frame, the purchase is final and will be charged to the credit card or payment method entered by the User at the time of purchase. All of the above is without prejudice to the Specific Terms and Conditions applicable to the tour, activity, or experience that is the subject of the contract. 

4. Payments

You can pay for your purchase with a credit or debit card through the Redsys payment platform. The selected card must remain valid until the date of the tour, activity, or experience for which the booking was made. 

TELEFÉRICO partners with payment service providers to offer the most convenient payment methods and keep your payment information secure. When you make a purchase, you agree not to use an invalid or unauthorized payment method.

TELEFÉRICO will also accept PayPal as a payment method, subject to the following terms and conditions.

5. Changes, modifications or cancellations

A credit card is merely a form of security. If you wish to make any changes, modifications, or cancellations to your purchase, you must do so prior to the date of the activity specified in the original purchase, as outlined in the Specific Terms and Conditions for the selected rate or offer. In other cases, the corresponding specified charges will apply.

7. Data protection

The personal information or data you provide will be processed in accordance with the provisions of the Privacy Policy, which is the only policy applicable to the Teide By Night shopping experience. When proceeding through the online purchase form, and without prejudice to your separate acceptance of this Privacy Policy and these T&Cs, TELEFÉRICO will process your personal data in accordance with the applicable legal bases, including the performance of the contract described in these T&Cs and, where applicable, your consent.

Therefore, you acknowledge and declare that all information or data you provide is true and accurate.

8. Disclaimer of Liability

Except as expressly provided in these T&Cs and to the extent permitted by law, TELEFÉRICO shall not be liable for any damages of any kind that may result from the information on our website being inaccurate, incomplete, or out of date, including errors and omissions. Similarly, it has no duty or obligation to verify or monitor its content and information.

9. Applicable Law

These T&Cs are governed by Spanish law, specifically by Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Protection of Consumers and Users (TRLGDCU); Law 7/1998, of April 13, on General Contract Terms; Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSICE); the EU General Data Protection Regulation 2016/679 of the European Parliament and of the Council, dated April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).

10. Conflict Resolution

Any dispute arising in connection with these T&Cs shall be submitted to the courts of the city of Santa Cruz de Tenerife, unless applicable law designates other courts as having jurisdiction for such purposes. If the user is considered a consumer, the applicable jurisdiction will be that of the user's place of residence.

If any provision of these T&Cs is declared invalid, the remaining provisions shall not be affected by such invalidity and shall remain in effect for the parties under the agreed terms. Any provision that may be affected by such invalidity shall be replaced with a provision that, in accordance with the law, most closely reflects the original intent.
